Terms and Conditions
The owner of the online store https://smartlife.ee (hereinafter the Shop) is SMARTLIFE e-Commerce OÜ (registration code 10614594), which has been registered in Tallinn, Republic of Estonia.
Validity of the contract of sale. Product and pricing information
The conditions of sale apply to the purchase of products from the Store. The prices of the products are indicated below each product. The price includes all possible components or taxes, but does not include shipping costs. Shipping costs depend on the buyer’s country and shipping address and the shipping method chosen. Shipping costs will be displayed after the buyer on the “Checkout” page has entered the billing or delivery address.
Composing an order
To order a product, you must add the desired product from the “e-Shop” page to the shopping cart by clicking on the “Add to cart” icon. Each time a product is added, the cart automatically opens and displays the content and prices added at that time. You can then return to the “e-Shop” page to continue shopping or go to the “Pay” page to complete the purchase. When you are on the “Pay” page, you must complete/choose all the required fields in the billing address. After which the shipping costs and the expected shipping time will be displayed. You can still change the shipping method displayed if multiple methods are available for your chosen product. Next, you need to choose the payment method, then agree to the “Terms and Conditions”. If everything is correct for you, click “CONFIRM ORDER AND PAY”. The contract enters into force upon receipt of the amount to be paid.
If the ordered goods cannot be delivered due to the end of the goods or for any other reason, the buyer will be informed as soon as possible and the amount paid (including shipping costs paid) will be returned without delay, but not later than 14 days after receiving the information.
Delivery
The products are sent to many countries, but before entering the shipping address (on the payment page or for registered customers according to their registration) the shipping options and the prices of the products for Spain peninsula are shown. The cost and estimated delivery time are displayed on the “Checkout” page after you enter your address. Different products may have different delivery options available. If the product has multiple shipping options, the customer can view all available shipping options by clicking the option displayed by default on the “Checkout” page. It may not be possible to ship to some regions (islands, etc.) or some countries. If no shipping options have been displayed but the customer still wants to purchase a product, the customer can email us an inquiry https://smartlife.ee.
PS: If your address is in a very remote area, please reconfirm the shipping options with us by the same email before your first order, even if our page has been showing some of the shipping availabilities.
Right of withdrawal for 14 days
After placing an order, the buyer has the right to withdraw from the contract for 14 days [for some specific products, the buyer may not have the right to withdraw if the relevant product meets the conditions listed in § 53 (4) of the Law on Law of Obligations]. The right of withdrawal does not apply to buyers who are a legal person.
To make use of the 14-day right of return, the ordered product must not be used in any other way than is necessary to guarantee the nature, characteristics and functioning of the product in a way that allows the product to be tested in a physical store. If the product has been used for purposes other than those necessary to verify the nature, characteristics and functioning of the goods or if it shows signs of use or wear, the store is entitled to reduce the refundable fee in accordance with the decrease in value. of the goods.
To return a product, the customer must submit a withdrawal request by email to the address https://smartlife.ee within 14 days of receiving the product. The shipping costs for the return of a product will be borne by the customer unless the reason for the return is an erroneous or defective item.
The buyer must return the merchandise within 14 days of submitting the request. Upon receipt of the returned products, the store will return the money to the buyer immediately, but at the latest within 14 days.
If the buyer has explicitly chosen a delivery method other than the cheapest usual delivery method offered by the WebStore, the WebStore does not have to reimburse the consumer for the cost that exceeds the cost associated with the usual delivery method.
Services covered by third parties
As the Store is primarily spetsialized on online marketing, it uses third party services to provide best services for our clients. As a rule payment service costs are fully covered only by the Store, the client doesn’t pay anything (excemption – in some cases by credit sales the credit provider might ask client to pay interest for credit etc and then such conditions are shown in contract between the credit provider and client). Involved third parties:
- Carefully chosed list of smart devices manufacturers with best quality and affordable prices. Focus is set on electronics supported by Smart Life app (smart home), CamHi app (smart cameras), Imou app (smart appliances), Insmart app (smart fitness gadgets).
- Payment and credit service providers:
- Stripe, Inc.
- LHV Bank AS.
- ESTO AS.
- Maksekeskus AS.
- Delivery services providers (delivery within Baltics and Finland takes usually 1-4 days, within Europe 1 week, products sent directly from Asia 1-4 weeks. Delivery time is specific for each product and variation and is shown at Single Product page, at Cart and at Checkout pages). Our delivery partners are:
- In Baltic States and in Finland – Omniva, Itella, Unisend.
- In another countries – country-specific providers for each.
The right to file a lawsuit
The Store is responsible for the lack of conformity of the goods sold to the buyer within the conditions of the contract or for a defect that was already present at the time of delivery of the item and that manifests itself within two years (for individuals) or one year (for legal entities) from the delivery of the goods. Within the first six months from the delivery of the item to the buyer, it is presumed that the defect was already present at the time of delivery of the item. It is the responsibility of the Store to refute the corresponding assumption. In case of defect, the buyer has the right to contact the store within a maximum period of two months by sending an email to https://smartlife.ee.
The Store is not responsible for defects that have occurred after the delivery of the merchandise to the buyer. If the product has defects for which the Store is responsible, the Store will repair or replace the defective product. If this is not possible, the Store will refund the money to the buyer. The store responds to the consumer’s complaint by email within 15 days.
Direct marketing and processing of personal data
The store uses the personal data entered by the buyer (including name, telephone, address, email and bank details) only to process the order and ship the merchandise to the buyer. The store transmits personal data to companies that provide delivery services for the purpose of delivering the products.
The Store may send newsletters and offers to the Buyer’s email address only if the Buyer has expressed a desire to receive them by checking the appropriate email notification box on the Store’s website. Buyer may opt out of receiving email offers and newsletters at any time by notifying Shop by email or by unchecking the notification box on Shop’s website.
Dispute resolving
If the buyer has any complaint about the Store, he should send it to https://smartlife.ee. If the buyer and the Store cannot resolve the dispute by agreement, the buyer may appeal to the Consumer Litigation Committee. You can familiarize yourself with the procedural conditions and apply HERE. The competence of the Contentious Consumer Commission is to resolve conflicts arising from a contract between the buyer and the Store. Review of the buyer’s claim by the commission is free. The buyer can also go to the consumer dispute resolution platform of the European Union.
